These Terms & Conditions (“Terms”) govern how Clean Cans CFL, LLC (“Clean Cans” or “we,” “us,” or “our”) will provide bin cleaning services (“Services”) to you, our customer (“you” or “your”). By signing up for and using the Services, you agree that these Terms together with any policies, service descriptions or attachments incorporated herein by reference form a binding agreement between you and Clean Cans that govern your use of the Services (“Agreement”).

1. Services, Plans and Frequencies

Clean Cans offers various service plans (www.cleancans.com/get-clean-cans). As we continue to improve our business and the Services we provide to our customers, these service plans, the associated fees, and the Services themselves are subject to change. If any such changes will materially impact you, we will communicate the changes to you in advance of making them.

As you sign up for the Services, you will select the desired service plan, and we will provide our Services in accordance with that selection. Regardless of the service plan you select, we aim to schedule you on a day that is the next-day following your trash and recycling pickup day whenever possible and to maintain the same weekday for recurring visits. Actual service dates may vary due to route optimization, holidays, weather, or other operational requirements. To keep you informed of service dates, we send updates and reminders via both email and text messages to the contact information associated with your account.

2. Fees, Billing and Payments

2.1 Fees and Fee Increases

Clean Cans will charge you fees based on the service plan you select and the applicable list price at the time of sign-up. Clean Cans may change the fees it charges you for the Services and any recurring service plan by providing you with reasonable advance notice via email or text message to the contact information associated with your account. Your continued use of the Services after any such changes go into effect will be deemed your acceptance of the new fees.

2.2 Billing and Payments

A valid payment card must be kept on file to use the Services. Payment terms may vary by service type, customer type, or promotional offer. We may require payment at the time of signup (prepayment) or process payment after service completion. The applicable payment timing will be communicated at the time of purchase or enrollment. Regardless of payment frequency, the card on file will be charged automatically for the agreed amount.

We accept all major credit and debit cards. If your payment fails for any reason, your account may be suspended until payment is received, and no future services will be provided until the balance is cleared.

2.3 Prepaid Plan Policy

Prepaid plans are non-refundable, except where Clean Cans fails to provide service or where there is a clear service failure attributable to us. If you cancel before fulfilling the Minimum Commitment set forth in Section 7, any unused portion of your prepaid term will be forfeited. In the rare event of a service failure, we may, at our sole discretion, apply a service credit or refund.

3. Handling of Unavailable Cans

If none of your trash or recycling cans are placed out or otherwise made available for cleaning on your scheduled service day, a non-refundable $10 fee will be charged to your card on file.

We allow up to two grace occurrences per service location per calendar year before this fee is applied. After the two grace occurrences, the fee will be charged for each additional missed visit.

If some but not all of your trash or recycling cans are made available, we will clean the cans that are available and you will be charged for the full number of cans under your service plan.

We send service reminders by email and SMS 5 days, 2 days, and 1 day before your scheduled service, giving you adequate opportunity to notify us of any issues or request a reschedule. It is your responsibility to ensure cans are accessible on the scheduled day.

4. Customer Responsibilities

You are responsible for keeping all contact and payment information current in our customer portal.

You are responsible for making all payments and any fees incurred due to payment failures that relate to any incorrect information you provide to or maintain with Clean Cans.

You are responsible for ensuring your cans are ready and available for cleaning on your scheduled service day. This includes:

– Placing cans in an accessible location by 7:00 AM.
– Keeping the service area free of obstructions, hazards, and aggressive animals.
– Ensuring cans are completely empty of all trash, liquids, chemicals, and hazardous waste.

Removal of trash from cans is not part of our standard service and may be done only at the driver’s discretion if it is safe and practical. Please notify us in advance if cans cannot be emptied prior to service.

At the start of service, we will identify and place a Clean Cans service sticker on the can(s) covered by your plan. These designated cans will remain the same throughout your subscription and cannot be swapped or substituted. Please do not remove the Clean Cans service sticker, as it helps our team identify your cans and confirms service to HOAs or other third parties.

If you move within our service area, contact us to update your service address. Your plan will continue under the same account and terms.

Any claim of damage must be reported to Clean Cans within 24 hours of service completion.

5. Clean Can Service Exceptions

We reserve the right to skip or reschedule service if conditions are unsafe, access is blocked, or in the event of holidays, safety concerns, severe weather, vehicle failure, or operational changes. We will strive to communicate such changes to you promptly.

6. Rescheduling or Cancelling a Service Date

If you wish to cancel or pause service, at least 7 days’ notice prior to your next scheduled visit is required to avoid being charged. Same-day cancellations are subject to the $10 Cans Not Available fee. Customers may request up to two reschedules in each calendar year at no charge with at least 24 hours’ notice.

7. Your Minimum Commitment of 3 Cleanings

Upon signing up for a recurring service plan, you acknowledge that you are committing to a minimum of three completed cleanings and three corresponding payments on your service plan (“Minimum Commitment”) before you can cancel your recurring service plan in accordance with Section 8.

8. Changing Your Recurring Service Plan

You may adjust your recurring service plan and frequency at any time prior to your next scheduled service date and we will charge you the price difference to do so based on whatever our current rates are for the new recurring service plan you select. A change in your recurring service plan will not reset the Minimum Commitment but will require you to complete the Minimum Commitment based on the modified service plan frequency and associated fees.

After you fulfill your Minimum Commitment or if Clean Cans increases your fee prior to you completing your Minimum Commitment, you may cancel your recurring service plan by providing notice to Clean Cans at least 7 days prior to your next scheduled service. You may provide this notice by calling us directly, sending us an email, or reaching out to initiate the process via text. If you cancel your recurring service plan prior to fulfilling the Minimum Commitment and such cancellation is not made due to a fee increase that occurred in the prior 30 days, your card on file will be charged the difference between the cleanings you have paid for and the remaining cleanings needed to satisfy the Minimum Commitment.

9. Credit Policy

If we fail to provide service due to our own error, we will either re-clean your cans at no cost or issue a service credit. Service issues must be reported within 24 hours of completion to be eligible for re-cleaning or credit. All fees for missed cans, inaccessible cans beyond the two grace allowances per calendar year, or same-day cancellations are non-refundable.

10. Disclaimers and Limitation of Liability

You understand that Clean Cans cannot guarantee the elimination of all contagions in or around your garbage or recycling cans through your use of the Services. While the Services aim to clean such cans, Clean Cans makes no claims that the Services eliminate or otherwise prevent disease, germs, or other contagions. Nor is Clean Cans responsible for any normal wear and tear on the cans caused by cleanings or any pre-existing damage to the cans.

For any cases of actions, claims or assertions arising under this Agreement or related to the Services, Clean Cans’ liability in the aggregate to you will not exceed the fees paid by you to Clean Cans for the Services during the 12 months prior to the date the claim is made, regardless of the form of action (whether based on contract, tort, negligence, strict liability, or otherwise). IN NO EVENT WILL CLEAN CANS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, CONSEQUENTIAL, EXEMPLARY, OR SPECIAL DAMAGES OF ANY TYPE OR NATURE, EVEN IF CLEAN CANS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Communications and Consent

Clean Cans relies primarily on SMS text messaging for important communications such as service reminders, schedule changes, and service completion notifications. Because these updates are essential to providing your service, you cannot opt out of receiving transactional SMS messages without discontinuing your Service.

You may communicate with us by email ([email protected]), text (407-318-2717), or via a phone call (321-402-4470).

We use secure third-party processors to store and handle payment card information. By signing up, you consent to receive service-related messages, as well as billing notices and occasional promotional offers, via email and SMS. Standard messaging and data rates may apply.

12. Changes to this Agreement

We may update this Agreement by updating these Terms at any time. Updated versions of these Terms will be posted on our website with a new effective date. Continued use of our Services after the updated Terms are posted constitutes your acceptance of the changes.

For material updates, such as new fees or changes in billing practices, we will also notify you by email, as part of your invoice, and/or by text message.

We may, at our sole discretion, waive or modify any term of this Agreement without creating a continuing obligation to do so.

13. Governing Law and Disputes

This Agreement is governed by the laws of the State of Florida, without regard to any conflict of law principles. All disputes arising out of or related to this Agreement will be exclusively brought and exclusively maintained in the applicable State or Federal courts located in Orange County, Florida. Each party consents to and waives any objection to the exclusive personal jurisdiction and venue of such State and Federal courts.

14. Clean Cans Reserves the Right to Terminate Your Service

We reserve the right to terminate your service for repeated missed cleanings beyond the two grace allowances per calendar year, unsafe working conditions, non-payment, your card issuer (or its agent or affiliate) seeking return of payments previously made to Clean Cans, or any violation of this Agreement.

Acknowledgment: By subscribing to Clean Cans services, you confirm that you have read, understood, and agreed to these Terms & Conditions.
